Integration of Mediation Processes on Buddhist Peaceful Means: A Case Study of Insurance Dispute Mediation of Office of Insurance Commission

Abstract

The study has the objectives: 1) to study the condition of problems, context, and theory related to the development of insurance dispute mediation process of Office of Insurance Commission (OIC); 2) to study the principles of Dharma and Buddhist peaceful methods that promote the development of mediation processes in the performance of insurance dispute mediation. 3) to integrate the mediation process in accordance with Buddhist peaceful methods of Office of Insurance Commission. The study used a qualitative research method that included documentary research and action research by in - depth interviews with OIC's mediators 20 persons. The obtained data were analyzed and presented by content analysis.


From the study, the following results are found: 1) The condition of the problem in the context of the insurance dispute arises from the conflict between the complainant and the insurance company in terms of benefits or compensation where there is a conflict of interest in the amount of money. Once mediation is reached, disputes can be settled and mediators now adhere to Western-based mediation procedures. 2) The principle of Buddhist peaceful means is one of the methods used by the Buddha as a tool to settle conflicts peacefully and without violence, and the Four Noble Truths (Ariyasacca) are principles that promote the development of a comprehensive and systematic mediation process. 3) When applying the Dharma principles according to the Buddhist peaceful method to be applied to the insurance dispute mediation process by integrating the process of mediating disputes that are in line with the problems of Office of Business Promotion and Operations Commission Insurance has 5 steps: 1) mediation preparation (knowing problems, knowing suffering) 2) opening a mediation meeting (consciously using the middle path) 3) negotiating to find alternatives together (using wisdom, thinking right, without prejudice) 4) negotiate the right solution (negotiate the right way 5) conclusion of the mediation results (Building peace, creating peace, calming). As a result, it appears that the insurance dispute mediation of Office of Insurance Commission can be terminated both internally and externally by peaceful means.
