The Improvement of Legal Measures of Electronic Local Government for Smart Local Government Development Case Study Supplies Management by Electronic Government Procurement in Nakhon Sawan Province

Abstract

The research article consisted of the following objectives: 1) to study legal issues related to electronic local administration; and 2) to explore the guidelines for enhancing legal measures in driving the electronic local administration. The study applied a qualitative research method by way of in-depth interview with 3 groups of key informants which were: 1) administrators in the local government organizations; 2) officers of local government organizations; and 3) local legal experts in Nakhon Sawan Province, in a total of 30 persons. The group meeting was also conducted with 8 experts. The data were analyzed by way of content analysis. From the study, the following results are found: The legal issues are as follows: (1) problems in defining procurement terms; (2) problems with the criteria for defining the scope of procurement; (3) problems with the criteria of procurement methods; (4) problems with the criteria of inspection and preliminary selection of those who are eligible for bidding; (5) problems with criteria for determining the period for procurement; (6) problems with criteria for filing an appeal; (7) problems with criteria for announcing the results of purchasing or hiring; and (8) problems with criteria for managing contracts. The guidelines for enhancing legal measures in driving the electronic local administration on a case study of parcel management by electronic procurement consist as follows: (1) the legal amendment to be consistent with the context of each organization; (2) the establishment of clear practices in various matters; (3) the promotion for the operations manual at both the corporate and individual level; (4) the building of network of legal advisors in other agencies; (5) the provision of training for additional legal knowledge; and (6) making remarks on procurement in various issues as a guideline of practice.
