PROBLEMS OF CREATING A CENTRAL MAP OF PUBLIC LANDS IMPACTING THE PRIVATE SECTOR

Abstract

This article examines the problems of a project for improving integrated public land boundaries at a 1:4,000 map scale, or One Map Project, impacting the private sector. This implementation is similar to the Republic of Indonesia's One Map Policy (OMP: Kebijakan Satu Peta: KSP). The One Map initiative provides 13 rules for improving overlapping public land boundary maps, which may be classified into 3 types of rules for improving overlapping public land boundaries: increased public land boundaries; firstly regulated public land boundaries; and theoretically surveyed public land boundaries. Results revealed that the One Map Project did not resolve existing issues and may increase the quantity of problems affecting the private sector, especially rights for land owned by private ownership or possessive rights caused by central rules for improving the public land boundary map. This article, besides providing solutions to the aforementioned problems, also proposes legislation to enforce a revised public land boundary map and to revise the related legal process for proving land rights in issuing land title deeds by examining the revised state land boundary map. This can help land officials more efficiently consider the issuance of land rights documents and reduce the problem of official corruption related to the issuance of land rights certificates.
