Abstract

The research article attempted to provide knowledge regarding the importance of negotiating in cases when tourists face legal problems, whether they are criminal cases such as theft, fraud, accidents, etc., or civil cases such as breach of lodging contracts, boat rental cases, car rental cases, etc. All of these conflicts occur between Thais and foreigners, and mediators must comprehend the many contexts beginning with communication, such as spoken language and tone of voice. For example, Koreans speak harshly or aggressively, whereas Japanese communicate softly, etc. Physical language includes expressions and gestures (for example, facial expression and smashing the table, not paying respect to the places). Various cultures and religions have different ways of thought and customs. Mediators must understand the context of the many nations involved in this process in order for the mediation to be successful and to foster cordial relationships with foreigners. Understanding foreign cultures and traditions will facilitate mediation between both Thai disputing parties, as foreign victims frequently believe that Thai mediators will side with their fellow Thais. As a result, friendliness and exposure to diverse cultures will enable the victim to feel impartial toward the mediators and encourage the foreigner to engage in the mediation process. So, if the case is successful and all parties are satisfied, the foreigner will want to return to Thailand, which is beneficial to the country.
