บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาสภาพและลักษณะของการแก้ไขปัญหาที่ดินทำกินในพื้นที่ป่าอนุรักษ์ 7 จังหวัดภาคใต้ตอนล่าง 2) วิเคราะห์แนวทางและกลไกเพื่อแก้ไขปัญหาที่ดินทำกินในพื้นที่ป่าอนุรักษ์ 7 จังหวัดภาคใต้ตอนล่าง และ 3) จัดทำข้อเสนอเชิงนโยบายในการแก้ไขปัญหาที่ดินทำกินในพื้นที่ป่าอนุรักษ์ 7 จังหวัดภาคใต้ตอนล่างอย่างยั่งยืน เป็นการวิจัยเชิงคุณภาพโดยศึกษาจากข้อมูลเอกสารที่เกี่ยวข้อง ข้อมูลจากการสัมภาษณ์เชิงลึกจำนวน 388 คน การสัมภาษณ์ไม่เป็นทางการบุคคลที่เกี่ยวข้องกับการแก้ไขปัญหาที่ดินทำกิน การจัดประชุมแบบมีส่วนจำนวน 42 ครั้งและการเข้าร่วมกิจกรรมต่าง ๆ ในพื้นที่ ภายในกรอบระยะเวลา 11 เดือน ผลการศึกษาพบว่า 1) สภาพและลักษณะของการแก้ไขปัญหาที่ดินทำกินมีความไม่สอดคล้องกันของแนวทางและความต้องการระหว่างภาครัฐที่เน้นการพิสูจน์สิทธิตามกฎหมายและบริหารจัดการที่ดินตามนโยบาย และภาคประชาชนและองค์กรชุมชนที่ต้องการความเป็นธรรมในสิทธิที่ดินทำกินและเอกสารสิทธิ์ในที่ดิน 2) แนวทางและกลไกเพื่อแก้ไขปัญหาที่ดินทำกินนั้นภาครัฐใช้กลไกการพิสูจน์สิทธิเอกสารการเข้าครอบครองตามกฎหมายและบริหารจัดการที่ดินตามนโยบาย และภาคประชาชนและองค์กรชุมชนใช้แนวทางการรวมกลุ่มเพื่อเรียกร้องความเป็นธรรมในสิทธิที่ดินทำกินและเอกสารสิทธิ์ในที่ดิน และ 3) ข้อเสนอเชิงนโยบายในการแก้ไขปัญหาที่ดินทำกินในพื้นที่ป่าอนุรักษ์ 7 จังหวัดภาคใต้ตอนล่างอย่างยั่งยืนนั้นจะต้องสร้างกลไกการแก้ไขปัญหาอย่างมีส่วนร่วมที่แท้จริง
