บทคัดย่อ
บทความวิจัยนี้ มีวัตถุประสงค์เพื่อนำเสนอรูปแบบการไกล่เกลี่ยข้อพิพาทภาคประชาชน โดยหลักพุทธสันติวิธีของตำบลสวาย อำเภอปรางค์กู่ จังหวัดศรีสะเกษ เป็นงานวิจัยเชิงคุณภาพ โดยกลุ่มผู้ให้ข้อมูล ได้แก่ ผู้นำชุมชน ข้าราชการและผู้ทรงคุณวุฒิ จำนวน 35 คน โดยใช้วิธีเลือกแบบเจาะจง ผู้ให้ข้อมูลสำคัญ ประกอบด้วย 1) ผู้นำชุมชน คือ กำนัน 1 คน ผู้ใหญ่บ้าน 9 คน ผู้ช่วยผู้ใหญ่บ้าน 12 คน และผู้นำท้องถิ่น 2 คน 2) ข้าราชการ 4 คน 3) ผู้ทรงคุณวุฒิด้านการไกล่เกลี่ยข้อพิพาท จำนวน 7 คน เครื่องมือที่ใช้ในการวิจัยครังนี้ เป็นแบบสัมภาษณ์เชิงลึกที่ผ่านกระบวนการสร้างและตรวจสอบคุณภาพจากผู้เชี่ยวชาญ มีการเก็บรวบรวมข้อมูลจากในพื้นที่และนำมาวิเคราะห์เนื้อหาโดยเขียนบรรยายเชิงพรรณนา
ผลการวิจัย พบว่า รูปแบบการไกล่เกลี่ยข้อพิพาทภาคประชาชนโดยหลักพุทธสันติวิธีของ ตำบลสวาย อำเภอปรางค์กู่ จังหวัดศรีสะเกษ สามารถออกแบบมาเป็นรูปแบบการไกล่เกลี่ยข้อพิพาท ภาคประชาชนโดยหลักพุทธสันติวิธี ประกอบด้วย (1) หลักการไกล่เกลี่ยข้อพิพาทภาคประชาชน ประกอบด้วย การสมัครใจของทุกฝ่าย การผ่อนปรนให้แก่กัน การฟื้นฟูความสัมพันธ์ของคู่กรณี และการยุติคดีด้วยความพึงพอใจ (2) ขั้นตอนการไกล่เกลี่ยข้อพิพาทภาคประชาชนโดยหลักพุทธสันติวิธี ประกอบด้วย วิเคราะห์ปัญหาตามหลักอริยสัจสี่ เปิดเวทีพูดคุยด้วยพรหมวิหาร จัดสานเสวนาแบบกัลยาณมิตร สร้างทางเลือกโดยไม่มีอคติสี่ และจบลงด้วยดีบนสามัคคีธรรม
