ปัญหาทางกฎหมายเกี่ยวกับการนำการระงับข้อพิพาทออนไลน์มาใช้ในประเทศไทย

บทคัดย่อ
บทความนี้มีวัตถุประสงค์เพื่อศึกษาแนวทางในการนำการระงับข้อพิพาทออนไลน์มาใช้ในประเทศไทย โดยผู้เขียนนำ Technical Notes on Online Dispute Resolution ซึ่งจัดทำโดยคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติมาเป็นแนวทางในการปรับใช้เพื่อกำหนดกลไกหรือระบบหรือหลักเกณฑ์ทางกฎหมายในการระงับข้อพิพาทออนไลน์ที่เหมาะสมกับประเทศไทย เนื่องจากมีการนำระบบการระงับข้อพิพาทออนไลน์ในประเทศไทยแล้ว โดยสถาบันอนุญาโตตุลาการ (Thailand Arbitration Center : THAC) ได้พัฒนาระบบทอล์คดีดี (TalkDD) ขึ้นมา แต่ยังไม่ได้รับความนิยมและยังไม่เป็นที่แพร่หลายด้วยสาเหตุหลายประการ เช่น การระงับข้อพิพาทออนไลน์นั้นไม่มีสภาพบังคับทางกฎหมาย และไม่มีกฎหมายเฉพาะที่นำมาปรับใช้ เป็นต้น ดังนี้ผู้เขียนจึงเสนอแนะแนวทางในการในการแก้ไขปัญหาดังกล่าว
