Abstract

This research entitled of the problems on protection of children and persons with intellectual disability who are sexual harassment victims has its objective to (1) study the problems on protection of children and (2) persons with intellectual disability who are sexual harassment victims. Methodology of this study was a qualitative research by using documentary research. The results revealed that (1) the offence of rape on children with intellectual disability was not enacted in the Criminal Code of Thailand, while New York, Oklahoma, Ohio and United Kingdom had their laws clearly and also set the highest rate of punishment at life sentence. Under the Criminal Procedure Code of Thailand, no specific measures were enacted for interrogation of persons with intellectual disability that had their ages more than 18 years old which differed from Florida and United Kingdom that enacted such special measures for interrogation of those with intellectual disability (2)The Criminal Code of Thailand should be amended by enhancing of offences and penalties for the offence of raping child with intellectual disability rape and Section 133 bis of the Criminal Procedure Code should be amended.
