LEGAL PROBLEMS REGARDING LAW ON ENTERTAINMENT BUSINESS

Abstract

The dissertation aims to study basic information of Entertainment business, theory about the control on the operation of Entertainment, legal measure to govern the operation of such business both in Thailand and international including legal issues and resolutions, in order to sustainably improve and resolve problems about the operation of Entertainment in Thailand.

          The study found that:

          “Entertainment Business Act B.E. 2509” intends to govern the operation of entertainment business however, in practice, there are some issues risen from the enforcement of the Act, such as, the definition, the inspection of entertainment business by government, the area of location and opening hour of entertainment and the criminal and administrative penalty determination according to the Entertainment Business Act B.E. 2509 and the order of National Council for Peace and Order (NCPO) no.22/2558 and no.46/2559 with respect to the measurement on the control of entertainment business. Therefore, the researcher sees that the laws governing the operation of entertainment business should be repealed and be amended into one law which operates the control, the inspection, the penalty for noncompliance with the law on entertainment business, including the new definition that properly cover the status quo of the entertainment business as it is in the present. Furthermore, the issues also risen from the inspection of entertainment business under the operation of the manuals and orders of state officials where the conflict of the status of law were controversial issues. The issues aforementioned led to the uncontrollable situation of entertainment business in Thailand to comply with the objective and will of the laws.
