Abstract

Background and Aims: The effectiveness of the pre-litigation process is the heart of the Thai Court of Justice’s strategic plan efforts. Therefore, this article aims to 1. examine the concordance between the pre-litigation mediation process model and empirical evidence; 2. create and verify a pre-litigation mediation process model in the court of first instances under the Administrative Office of the Court of Justice, Region IV.

Methodology: This study is divided into two phases. The first phase examined the concordance between the pre-litigation mediation process model used by the court of first instances under the Administrative Office of the Court of Justice, Region IV, and empirical evidence based on a quantitative approach with 250 people as samples. Two-phase sampling is used (quota-based non-probabilistic sampling and lottery-based probabilistic sampling). The research tool was a questionnaire, and data were analyzed using correlation coefficient analysis, confirmatory factor analysis (CFA), and system equation model analysis. The second phase covered the creation and verification of the pre-litigation mediation process model in the court of first instances under the Administrative Office of the Court of Justice, Region IV. This phase used a mixed-methods approach to create a model, which was verified by 17 experts selected by purposive sampling. The research tool in the second phase was an evaluation form. Data analysis was done by calculating the median, IQR, consensus, and in-depth interview of 10 key informants, who were selected by purposive sampling. The research tool was an interview form, and the data was presented by description.

Result: the study found that 1. The pre-litigation mediation process model in the court of first instances under the Administrative Office of the Court of Justice, Region IV, had a good concordance with empirical evidence, and 2. The pre-litigation mediation process model in the court of first instances under the Administrative Office of the Court of Justice, Region IV, was the most suitable, and the expert consensus confirmed the suitability.

Conclusion: the pre-litigation mediation process model in the court of first instances under the Administrative Office of the Court of Justice, Region IV, was developed based on a theoretical basis, and relevant agencies can apply the indicators to achieve their goal.
