Abstract

The study of legal standards in promotion and protection of the community enterprise to protect the community identity. Case study: Ban Mon Community, NaKhon Sawan province. The research purposes are 1) to study “Ban Mon community” in order to promote and protect the community identity. 2) to analyses ideas, forms and legal factors that affect Ban Mon Community. 3) to study guidelines and legal measures in promotion and protection of the community identity for sustainable development by a qualitative research which include questionnaire and a depth interview. The research will be done by survey tools, academic document, related researches, textbooks, online medias and related articles in the following issues 1) according to the study, a group of Ban Mon pottery community enterprise causes by a group of pottery career members who brought a local knowledge from ancestor combined with cultore, tradition, custom and Mon’s living for pottery making process and pattern. Including, soil that has a local identity and the discovery and development of new designs based on the cost of a traditional knowledge. The government has set ways to promote the community enterprise to improve the quality of people by rein fore with knowledge and constitutional creativity. Moreover, there are the community enterprise act and the revenue code to protect the community enterprise identity.            2) concepts, forms and legal factors that affect the community enterprise from the study found that the Ban Mon pottery community enterprise integrated with a concept that supported and developed by the government in order to loan from a bank and improve their enterprise.Form of the Ban Mon pottery community enterprise is registered famer groups in amphur muang, Nakhon Sawan province to obtain the government’s support. The objectives of the community enterprise are to produce their products, generate revenue to the community and become self-reliant in their family, community and between communities. Furthermore, a local knowledge of Ban Mon would add product value follow by the community enterprise act, and the community-based social and economic development policies and plans No.11 comply with the Agenda 21, the Declaration of Johannesburg on sustainable development to support and develop the community enterprise. 3) guidelines and legal measures to support and protect the Ban Mon community identity by training, seminal for the purpose of promote and develop the community enterprise groups, but the government should develop various forms of pottery making to create a selling point, public relation and promotion with financial support and fund. Besides, there should have legal measures in the pottery community enterprise under the rules of intellectual property by trademark registration, certificate mark and the registration of geographical indication for sustainable development.
