Legal Measures concerning guarantee and protection of disabled persons’ rights on performance and working to employers

Abstract

This thesis has purposes to study the background concept and theory of Human rights in particular human rights concerning the disabled persons protection and related researches including problems, law enforcement, barriers, weak and strong points of legal measures at Thailand and foreign countries relating to required qualifications or prohibited characteristics of disabled persons for recruitment, the disabled persons protection regarding carrying on the occupations and related international agreements including study and comparative analyze legal measures relating to guarantee and protection of disabled persons’ rights on performance and working to employers both domestic and international in order to suggest appropriate legal measures and apply to be the guideline on development legal measures regarding guarantee and protection of disabled persons’ rights on performance and working to employers that are deemed to be
important in extremely studying and analyzing. Research methodology, researcher determines the scope of content and example population The Findings of the study were concluded as follows:
The results of a research found that the guideline on this solutions, related agencies or organization should promote empowerment and encouragement to create a self-supporting to disabled persons rights. Moreover, Disabilities Thailand should provide campaigns against laws limiting disabled persons in order that mass media helps publicize injustice in laws and should amend Ministerial Regulation (B.E.๒๕๓๗) issued under rehabilitation for disabled persons Act B.E. ๒๕๓๔, for empowerment and encouragement to create a self-supporting to disabled persons, by revoking Department of Public Welfare Notification subject: Determination characteristics of work that disables persons are able to do, and should amend States Enterprises regulations that contain unfair-discriminate language explicitly, etc. For the purpose that Thai laws relating disables persons working have the standard equal to international standard.
