บทคัดย่อ
การวิจัยนี้มีวัตถุประสงค์เพื่อ 1) จัดการความรู้ตามบทบัญญัติของกฎหมายเกี่ยวกับการยุติความขัดแย้งโดยยุติธรรมชุมชนตามพระราชบัญญัติการไกล่เกลี่ยข้อพิพาท พ.ศ. 2562 2) จัดทำร่างธรรมนูญชุมชนในการยุติความขัดแย้งโดยยุติธรรมชุมชนตามพระราชบัญญัติการไกล่เกลี่ยข้อพิพาท พ.ศ. 2562 แบบมีส่วนร่วม จังหวัดอุดรธานี และ 3) ถ่ายทอดกลไกความร่วมมือในการยุติความขัดแย้งโดยยุติธรรมชุมชนตามพระราชบัญญัติการไกล่เกลี่ยข้อพิพาท พ.ศ. 2562 ผ่านธรรมนูญชุมชน การวิจัยนี้ใช้วิธีการวิจัยแบบผสมผสาน การวิจัยเชิงปริมาณ เก็บข้อมูลด้วยแบบสอบถาม การวิจัยเชิงคุณภาพ เก็บข้อมูลโดยการสัมภาษณ์เชิงลึก การสนทนากลุ่ม และใช้การวิเคราะห์เนื้อหา
ผลการวิจัยพบว่า 1) ศูนย์ไกล่เกลี่ยข้อพิพาทภาคประชาชนสามารถลดข้อขัดแย้งระหว่างบุคคล ลดค่าใช้จ่าย และลดปริมาณคดีในชั้นศาลได้ ศูนย์ยุติธรรมชุมชน และธรรมนูญชุมชนเป็นกลไกการขับเคลื่อนความร่วมมือในการลดความขัดแย้งในชุมชน โดยระดับความเห็นการประเมินข้อมูล = 3.72 คิดเป็นร้อยละ 74.45 และมีค่า S.D. = 1.11 แปลผล = มาก สะท้อนให้เห็นว่าชุมชนมีทัศนะเชิงบวกในการนำธรรมนูญชุมชนมาเป็นกลไกในการขับเคลื่อนการไกล่เกลี่ยข้อพาทในชุมชน 2) (ร่าง) ธรรมนูญชุมชน เป็นกลไกการขับเคลื่อนความร่วมมือในการยุติข้อขัดแย้งโดยยุติธรรมชุมชนลดปัญหาข้อขัดแย้ง สร้างความสมานฉันท์ 3) การถ่ายทอดกลไกความร่วมมือในการยุติข้อขัดแย้งในชุมชน ดำเนินการแบบมีส่วนร่วมอาศัยอำนาจตามรัฐธรรมนูญแห่งราชอาณาจักรไทย มาตรา 26 และมาตรา 43 (1) จัดทำร่างธรรมนูญชุมชนในการยุติข้อขัดแย้ง สอดคล้องกับนโยบายการลดปริมาณคดีของศาลยุติธรรมที่มีเป้าหมายในการลดปริมาณคดีที่เข้าสู่ระบบศาล โดยส่งเสริมการไกล่เกลี่ยข้อพิพาททั้งในคดีอาญาและคดีแพ่ง
