การป้องกันและปราบปรามการทรมานและการกระทำให้บุคคลสูญหาย : ความสำคัญและความท้าทาย

บทคัดย่อ
บทความนี้มีวัตถุประสงค์เพื่อวิเคราะห์การออกกฎหมายพระราชบัญญัติป้องกันและปราบปรามการทรมานและการกระทำให้บุคคลสูญหาย พ.ศ. 2565 ของประเทศไทย ซึ่งเป็นก้าวสำคัญในการปกป้องสิทธิมนุษยชนในมิติของการป้องกัน ปราบปราม และเยียวยาผู้เสียหายจากการกระทำที่ละเมิดศักดิ์ศรีความเป็นมนุษย์อันเกิดจากการทรมานหรือการทำให้บุคคลสูญหาย รวมถึงการปรับปรุงกระบวนการยุติธรรมและกำหนดมาตรการที่เข้มงวดต่อเจ้าหน้าที่รัฐที่ละเมิดสิทธิของประชาชน โดยมีการกำหนดโทษทางอาญาอย่างชัดเจน ตลอดจนวิเคราะห์มิติต่าง ๆ ที่เกิดขึ้นจากการออกกฎหมายข้างต้น
แม้การบังคับใช้กฎหมายดังกล่าวจะเป็นความก้าวหน้าที่สำคัญ แต่ก็ยังเผชิญกับความท้าทายในด้านการขาดแคลนทรัพยากร ความจำเป็นในการสร้างความตระหนักรู้ของสาธารณชนและความร่วมมือจากหน่วยงานต่าง ๆ ข้อเสนอแนะในบทความนี้ จึงเน้นให้กรมคุ้มครองสิทธิและเสรีภาพเพิ่มการเผยแพร่ความรู้เกี่ยวกับสิทธิมนุษยชน จัดหาอุปกรณ์เทคโนโลยีในการบันทึกการควบคุมตัวให้เพียงพอ และฝึกอบรมเจ้าหน้าที่รัฐเพื่อให้การบังคับใช้กฎหมายมีประสิทธิภาพและโปร่งใสมากยิ่งขึ้น
