บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์ 1) เพื่อศึกษาบริบท สภาพปัญหา และความต้องการพัฒนาการบริหารจัดการศูนย์ไกล่เกลี่ย และแนวคิดทฤษฎีการบริหารจัดการศูนย์ไกล่เกลี่ยข้อพิพาทภาคประชาชน 2) เพื่อศึกษาหลักพุทธสันติวิธีที่ส่งเสริมการพัฒนาการบริหารจัดการศูนย์ไกล่เกลี่ย 3) เพื่อพัฒนาและนำเสนอรูปแบบการบริหารจัดการของศูนย์ไกล่เกลี่ยข้อพิพาทภาคประชาชน โดยพุทธสันติวิธี ตำบลสวาย อำเภอปรางค์กู่ จังหวัดศรีสะเกษ เป็นการวิจัยเชิงคุณภาพ โดยการศึกษาเอกสาร และเชิงปฏิบัติการ ด้วยการสัมภาษณ์เชิงลึก จำนวน 21 คน ณ ตำบลสวาย โดยนำข้อมูลมาวิเคราะห์เนื้อหา และนำเสนอเชิงพรรณนา
ผลการวิจัยพบว่า 1) ที่ผ่านมาชุมชนไม่เห็นความสำคัญในการจัดตั้งศูนย์ไกล่เกลี่ยข้อพิพาท
ภาคประชาชนตาม พรบ. การไกล่เกลี่ยข้อพิพาท พ.ศ. 2562 และไม่มาใช้บริการ ประกอบกับคณะทำงาน และผู้ไกล่เกลี่ยยังขาดความรู้ทางกฎหมายที่เกี่ยวข้องและทักษะในการไกล่เกลี่ยตาม พรบ. ทำให้ขาดความเชื่อมั่นในการปฏิบัติงาน 2) ผู้วิจัยได้นำแนวคิดทฤษฎีหลักการบริหาร 4M’s และ7s McKinsey กระบวนการตรวจสอบการบริหารภายในองค์กร และเกณฑ์มาตรฐานศูนย์ไกล่เกลี่ยข้อพิพาทภาคประชาชน 4 ด้าน มาทำการวิเคราะห์และสังเคราะห์ตามแนวทางการวิเคราะห์ปัญหาของอริยสัจ 4 ประกอบด้วย 4 ขั้นตอน คือ (1) ขั้นทุกข์ การค้นหาสภาพปัญหา (2) ขั้นสมุทัย การค้นหาสาเหตุของปัญหา (3) ขั้นนิโรธ การกำหนดวิสัยทัศน์การดำเนินงาน และ (4) ขั้นมรรค การค้นหากลยุทธ์ในการดำเนินงานให้บรรลุวิสัยทัศน์ 3) รูปแบบการบริหารจัดการศูนย์ไกล่เกลี่ยฯ ตำบลสวาย (SAWAI Model) มีองค์ประกอบ ดังนี้ (1) S : Skills คณะทำงานได้รับการพัฒนาทักษะการบริหารจัดการ และการไกล่เกลี่ย (2) A : Aspiration คณะทำงานมุ่งมั่นให้เกิดผลตามแรงบันดาลใจในการขับเคลื่อนศูนย์ไกล่เกลี่ยฯ (3) W : Wisdom คณะทำงานได้รับการพัฒนาปัญญาภายในและภายนอกให้เกิดผลสัมฤทธิ์ในการปฏิบัติงาน (4) A : Acknowledgement ชุมชนเชื่อมั่นในศูนย์ไกล่เกลี่ยฯ และใช้บริการศูนย์ไกล่เกลี่ยฯ (5) I : Integration การบูรณาการการทำงานร่วมกันของคณะทำงาน และการบูรณาการการทำงานร่วมกันกับหน่วยงานภายนอก
