การพัฒนากระบวนการไกล่เกลี่ยข้อพิพาท ในชั้นสอบสวนโดยพุทธสันติวิธีจังหวัดภูเก็ต

บทคัดย่อ
บทความวิจัยนี้ มีวัตถุประสงค์ 1) เพื่อศึกษาวิเคราะห์สภาพการไกล่เกลี่ยข้อพิพาทของพนักงานสอบสวนสถานีตำรวจภูธรป่าตอง จังหวัดภูเก็ต และ 2) เพื่อนำเสนอกระบวนการไกล่เกลี่ยข้อพิพาทในชั้นสอบสวนโดยหลักพุทธสันติวิธีจังหวัดภูเก็ต ใช้รูปแบบการวิจัยเชิงคุณภาพ แบบภาคสนาม โดยการศึกษาเอกสาร และการสัมภาษณ์เชิงลึกจากกลุ่มผู้ให้ข้อมูลสำคัญ โดยการศึกษาและเก็บข้อมูลจากผู้ที่มีทักษะ และความรู้ในการเจรจาไกล่เกลี่ยข้อพิพาทในชั้นพนักงานสอบสวน ผู้ร้องทุกข์และผู้ต้องหา และผู้ที่มีความรู้ในด้านการไกล่เกลี่ยข้อพิพาทเชิงพุทธ จำนวน 24 คน ใช้วิธีการวิเคราะห์ข้อมูล การตีความ โดยนำความรู้จากทฤษฎี วรรณกรรมที่เกี่ยวข้อง มาร่วมในการพิจารณา ผลการวิจัย พบว่า 1) การไกล่เกลี่ยข้อพิพาทในชั้นสอบสวนของสถานีตำรวจภูธรป่าตอง ได้ยึดตามระเบียบสำนักงานตำรวจแห่งชาติว่าด้วยหลักเกณฑ์ วิธีการ และเงื่อนไขการยื่นคำร้องขอไกล่เกลี่ยข้อพิพาททางอาญาและกระบวนการไกล่เกลี่ยข้อพิพาททางอาญา ตามพระราชบัญญัติไกล่เกลี่ยข้อพิพาท พ.ศ. 2562 2) หลักธรรมที่เป็นพื้นฐาน และเป็นตัวช่วยของกระบวนการไกล่เกลี่ยข้อพิพาทในชั้นสอบสวนโดยพุทธสันติวิธี คือหลัก “สติ ขันติ และสันติ” คือ มีสติในทุกขั้นตอนของกระบวนการเจรจาไกล่เกลี่ย มีขันติในทุกภาวะอารมณ์โทสะที่อาจจะเกิดขึ้นได้ในระหว่างกระบวนการไกล่เกลี่ย และเพื่อนำไปสู่เป้าหมายสุดท้ายคือ สันติสุขร่วมกัน กระบวนการไกล่เกลี่ยข้อพิพาทในชั้นสอบสวนโดยพุทธสันติวิธี มี 6 ขั้นตอน คือ 1) ค้นหาทุกข์ด้วยอริยสัจจ์ 2) เปิดโลกทัศน์ด้วยปิยวาจา 3) ยึดหลักสาราณียธรรมค้นหาประเด็น 4) ร่วมกันคิดเห็นโดยละอคติ 5) มุ่งมิติอภัยทาน 6) ร่วมติดตามอย่างสันติสุข
