Abstract

The objectives of this paper are 1) to study the theoretical concept of protection of doctors' work in Thailand and abroad. 2) To study the factual and legal issues related to legal measures to protect the work of doctors in Thailand, how there are problems and how to solve them. Legal measures to protect the work of doctors abroad whether there are problems similar to or different from Thailand. and 4) to suggest legal measures regarding the protection of the work of doctors abroad that are appropriate. to apply it effectively to Thai law.


The results of the research showed that: 1) The Labor Protection Act B.E. 2541 (1998) does not stipulate a ceiling for overtime working hours and the Medical Council Notification No. 46/2022 on the guidelines for determining the working time frame of public sector doctors is not a law, so it is not mandatory. The researcher suggested that the overtime hours of doctors should be determined, 2) the Ministry of Public Health Regulations B.E. 2566 (2023) stipulate that the remuneration for doctors is not suitable for the actual workload, and the remuneration should be set appropriately, 3) there is no provision that stipulates the responsibility of hospitals in case hospitals require doctors to work overtime, and the policy on the distribution of doctors to hospitals in other provinces is unclear. Therefore, the responsibility of the hospital should be determined in case the hospital requires doctors to work overtime.
