The Legal Status of Land Dedicated on Sangha Act 2505 B.E.

Abstract

The purposes of this research were: 1) to study background and significance of the legal status of dedicated lands on Sangha Act 2) analyze the legal status including legal protection 3) to study formats and managements of the legal status of dedicated land and 4) to suggest guidelines for revising both of existing laws and newly enacted laws

           The results were as follows: 1) Ministerial Regulation authorized temples for making benefits from dedicated lands in form of rental that was not consistent with statements of the Sangha Act B.E. 2505 and determined methods for temples to make benefits form dedicated lands only, but had not any details of granting benefits on dedicated lands to temples or religions 2) Many articles of the Sangha Act B.E. 2505 used word of religion made some difficulties for studying and understanding.

           Suggestion – The Sangha Act B.E. 2505 should be amended and clearly defined of religious definitions as well as amending ministerial regulations for covering in case of obtaining to provide clarity to the donors and the temples receiving the dedicated land.
