บทคัดย่อ

ศีลข้อที่ 3 คือ  การเจตนางดเว้นจากการประพฤติผิดในเรื่องเพศสัมพันธ์นั้น อรรถกถาจารย์ได้วางเกณฑ์ในการวินิจฉัยไว้โดยพิจารณาจากหญิงต้องห้าม 20 จำพวก ซึ่งเกณฑ์นี้ประสบปัญหาความไม่ครอบคลุมในการวินิจฉัย เนื่องจากสภาพสังคมที่เปลี่ยนไปทำให้เกิดพฤติกรรมทางเพศบางอย่างซึ่งพิจารณาได้ยากว่าผิดศีลหรือไม่ อีกทั้งพื้นฐานในการวางหลักเกณฑ์สำหรับวินิจฉัยเกิดขึ้นในสภาพการณ์ของสังคมที่ต่างกับปัจจุบัน บทความนี้จึงมุ่งหาเกณฑ์ที่จะวินิจฉัยว่าพฤติกรรมใดเข้าข่ายในการล่วงละเมิดศีลข้อที่ 3 โดยพิจารณาจากจุดมุ่งหมายในการบัญญัติศีลและเป็นสำคัญ

According to the Theravãda commentary, the criterion to judge the Third of the Five precepts (Pañca-Sȋla), namely abstention from sexual misconduct (Kãmesumicchãcãrã), is based on 20 kinds of prohibited women. Nevertheless, this criterion does not cover some sexual behaviors that are far too complicated from precious times due to social and cultural changes. Therefore, this article aims to explore the standard that can determine what sexual behaviors violate the Third of the Five precepts primarily relying on the objective of setting up the Sȋla.
