PROBLEMS AND OBSTACLES IN COMPLYING WITH THE LAW ON CONFLICT OF PERSONAL AND PUBLIC INTERESTS OF PUBLIC OFFICERS

Objectives of this research were to examine problems and obstacles in complying with the law on conflict of personal and public interests. The researcher used a qualitative research methodology. Data were collected by using in-depth interview with 10 executives, 21 heads of taskforce, 19 operational officers, and 2 academicians, including focus group discussion with 2 groups of public officers.
The findings were found that Problems and obstacles on the legal practice on the conflict of personal and public interests were as follows 1. The practice operators still lacked knowledge, understanding on legal principles. 2. The administrators had abused of power, using patronizing system, favoritism among relatives. 3.Some of the public officers could not differentiate between conflict of personal and public interests. 4. The ignorance of behavior on conflict of personal and public interests in the working units. 5. Lacked the effective monitoring, the public working units still did not have monitoring system linking the first person’s interest to the second-third person. 6. The overlapping of law enforcement.
7. The monitoring and law enforcement organizations lack the neutrality without actual freedom. And 8. Social, economic, political and cultural factors did not support the legal practice on the conflict of personal and public interests.
