ACCOUNTABILITY OF LAWYER’S PROFESSION ON THE VIOLATION OF ETHICS

Objectives of this research aims to 1) Study the fact and legal issues which have been arisen out of the ethical violations or the misconduct of lawyer’s ethics. 2) Study the origin of problematic issues, conceptual thought and theory in relation to lawyer’s accountability, the punishment of such misconduct and to build and develop cthics. and 3) Study to resolve the problems on the number of misconduct cases allegedly committed by lawyers. This research methodology is the qualitative methods. The researcher has analyzed data from documentary researches books, articles and other academic studies in relation to the subject together with the in-depth search from e-learning or available electronic data as well as in-depth interviews wherby there are three groups of research samplings on ethics which are 1) lawyers 2) personnel who
regulate and monitor ethical standard being exercised by lawyers and 3) those who are on other legal professions such as judges, public prosecutors, academics, law lec The outcome of this research reveals the finding of fact and legal issues that had been caused due to 1) the law that being used to regulate the ethics and behaviors of lawyer at the present time is not sufficient to resolve the problems on the increase of number of cases on lawyer’s ethics and 2) it becomes necessary to use other mechanisms to join with the enforcement of law that to be revised by using them in parallel. The researcher is of his opinion that in order to resolve the problems on the increased number of misconduct cases allegedly committed by lawyers can be sorted out by revising the law in regulating ethics and conduct of lawyers by increasing the lawyer’s responsibility on punishment and to add responsibility in regulating ethics among lawyers including other measurements in addition to legal measurement that to be used at the same time such as to educate ethics to young people as from the kindergarten through university, especially on the training for a Bachelor’s degree or a diploma in Laws and the Institute of legal Education of the Thai Bar as well as the Legal Training Institute of Lawyer Council of Thailand and provided that, in addition to the solution on the number of increased cases on lawyer’s ethical misconduct to be reduced, these measurements could also be used to improve image and lawyer’s standard in the eyes of Thai people, for the better.
