PROPERTIES OF BUDDHIST MONK WHO HAVING SPOUSE

Abstract

When the marriage between man and woman is registered, the spouses are husband and wife. If divorce does not happen or marriage is not cancelled by the Court, the marriage still exists.  Marriage shall not be terminated by obtaining Buddhist monkhood of husband. Properties acquired during his monkhood are set as separate properties and community properties. If marriage is terminated by divorce or being cancelled by the Court, they shall be divided to the spouses ; each spouse’s separate properties belong to his or her, community properties shall be divided equally between man and woman. If marriage is terminated
by wife’s death, spouses’ properties shall be divided in the same way and wife’s separate properties and community properties divided as her belongings shall devolve on her statutory heirs. If marriage is terminated by Buddhist monk’s death, his separate properties and community properties divided as his belongings shall become property of the monastery which is his domicile, shall not devolve on his statutory heirs.
