ข้อเสนอหลักทรัสต์มหาชนทางสิ่งแวดล้อมเพื่อการกำกับดูแลทรัพยากรธรรมชาติที่ดี

บทคัดย่อ
งานวิจัยนี้มีวัตถุประสงค์ 2 ประการ คือ (1) ศึกษาสภาพปัญหาเชิงหลักการและข้อจำกัดกฎหมายด้านการกำกับดูแลทรัพยากรธรรมชาติของรัฐที่ส่งผลต่อการทุจริตคอร์รัปชั่นเชิงนโยบาย และ (2) นำเสนอหลักการทรัสต์มหาชนทางสิ่งแวดล้อมเพื่อเพิ่มศักยภาพการตรวจสอบการใช้อำนาจของรัฐภายใต้กลไกทางตุลาการ โดยงานวิจัยนี้เป็นการวิธีวิจัยเชิงเอกสาร
ผลการวิจัยพบว่า (1) สภาพปัญหาเชิงแนวคิดในการอ้างสิทธิเหนือทรัพยากรธรรมชาติ เป็นผลมาจากการตีความของกลุ่มนักคิดเชิงอำนาจเด็ดขาด ตามหลักอำนาจอธิปไตยเหนือดินแดนแบบจักรวรรดินิยม ซึ่งเมื่อนำหลักการนี้มาประยุกต์ใช้ในกลุ่มกฎหมายสิ่งแวดล้อมทรัพยากรธรรมชาติ ทำให้หน่วยงานภาครัฐถือตนเสมือนเป็นเจ้าของทรัพยากรฯ จึงมีสิทธิและอำนาจในการใช้ประโยชน์ได้โดยเด็ดขาดเฉกทำนองเดียวกับหลักกรรมสิทธิ์ในทรัพย์สินแบบเอกชน เมื่อเป็นเจ้าของจึงไม่ต้องรับผิดชอบต่อความเสียหาย อีกทั้งไม่สามารถตรวจสอบดุลพินิจของคณะกรรมการภาครัฐได้ อันมีความเสี่ยงสูงต่อการใช้อำนาจหน้าที่ไปในทางคอร์รัปชั่นเชิงนโยบาย และ (2) ผู้วิจัยนำเสนอหลักการ “ทรัสต์มหาชนทางสิ่งแวดล้อม”เพื่อยกระดับการตรวจสอบการใช้ดุลพินิจของคณะกรรมการตามกฎหมายเฉพาะตามหลัก “ความรับผิดอย่างอื่น”ต่อประโยชน์สาธารณะทางสิ่งแวดล้อม
