การแก้ไขบำบัดฟื้นฟูเด็กและเยาวชนที่กระทำผิดในคดียาเสพติด : รูปแบบและมาตรการเชิงปฏิบัติของต่างประเทศกับการประยุกต์ใช้ในประเทศไทย

บทคัดย่อ
บทความวิจัยนี้มีวัตถุประสงค์เพื่อศึกษารูปแบบและมาตรการเชิงปฏิบัติในการแก้ไขบำบัดฟื้นฟูเด็กและเยาวชนที่กระทำผิดในคดียาเสพติดของต่างประเทศ ประกอบด้วย รูปแบบและมาตรการเชิงปฏิบัติตามแนวทางของสำนักงานว่าด้วยยาเสพติดและอาชญากรรมแห่งสหประชาชาติ ประเทศสหรัฐอเมริกา และกลุ่มประเทศยุโรป ใช้วิธีวิทยาการวิจัยเชิงคุณภาพโดยการวิจัยทางเอกสาร แล้วนำข้อมูลที่ได้มาวิเคราะห์อย่างเป็นระบบด้วยวิธีการวิเคราะห์เนื้อหา เพื่อสังเคราะห์หารูปแบบและมาตรการเชิงปฏิบัติที่เป็นแนวปฏิบัติที่ดีในการแก้ไขบำบัดฟื้นฟูเด็กและเยาวชนที่กระทำผิดในคดียาเสพติด สำหรับนำมาประยุกต์ใช้ในระบบการบริหารกระบวนการยุติธรรมสำหรับเด็กและเยาวชนของประเทศไทย ผลการวิจัยพบว่า รูปแบบและมาตรการเชิงปฏิบัติในการแก้ไขบำบัดฟื้นฟูเด็กและเยาวชนที่กระทำผิดในคดียาเสพติดของต่างประเทศมีลักษณะเด่นที่สำคัญ คือ เป็นการแก้ไขบำบัดฟื้นฟูที่คำนึงถึงประโยชน์สูงสุดของเด็กและเยาวชนบนฐานของระบบการจัดการรายกรณีที่มีรูปแบบผสมผสาน ซึ่งสามารถปรับเปลี่ยนโปรแกรมการแก้ไขบำบัดฟื้นฟูได้ตามสภาพปัญหาหรือความจำเป็นของเด็กและเยาวชนแต่ละคน โดยนำเอาตัวแบบทางการแพทย์มาใช้ในการบำบัดรักษาด้วยวิธีการลดอันตรายจากการใช้ยาเสพติด ร่วมกับการแก้ไขบำบัดฟื้นฟูและการดูแลภายหลังสิ้นสุดโปรแกรมที่มีครอบครัวและชุมชนเป็นฐาน เพื่อให้เด็กและเยาวชนสามารถหวนกลับคืนสู่สังคมได้อย่างเป็นปกติสุขอีกครั้งหนึ่ง รูปแบบและมาตรการเชิงปฏิบัติของต่างประเทศดังกล่าวจึงเป็นแนวปฏิบัติที่ดีที่กระบวนการยุติธรรมสำหรับเด็กและเยาวชนของประเทศไทยสมควรนำไปปรับประยุกต์ใช้เพื่อให้สอดคล้องกับบทบัญญัติแห่งพระราชบัญญัติการบริหารการแก้ไขบำบัดฟื้นฟูเด็กและเยาวชนที่กระทำผิด พ.ศ. 2561 และเพื่อให้เด็กและเยาวชนได้รับการคุ้มครองสิทธิ สวัสดิภาพ และอนาคตที่มั่นคงอย่างแท้จริงต่อไป
