A Comparative Legal Study of England and France: Laws Concerning the Transfer of Sub-district Health Promoting Hospital Functions to Provincial Administrative Organizations

Abstract
This article aims to analyze the legal problems and practical obstacles arising from the enforcement of the Determining Plans and Process of Decentralization to Local Government Organization Act, B.E. 2542 (1999) and related legislation concerning the transfer of Sub-district Health Promoting Hospitals to Provincial Administrative Organizations (PAOs). By employing a comparative legal approach, this study proposes solutions to these legal issues in order to elevate the quality and efficiency of primary public health service provision. The findings reveal two key interconnected legal issues: first, the inequality regarding legal status and personnel administration; and second, the legal impediments in budgetary management that fail to align with public health missions. Based on a comparative analysis of two developed nations-namely, the United Kingdom and France - the author proposes resolving these issues by amending the Ministry of Interior Regulation on Local Government Organization Budgeting, B.E. 2563 (2020), establishing a specific public health professional position registry within PAOs, and developing a localized budget allocation formula tailored to the distinct needs of each area.
