บทคัดย่อ
ารศึกษามาตรการทางกฎหมายในการคุ้มครองและจัดสวัสดิภาพสัตว์จากการน ามาแสดง
มีวตั ถุประสงคเ์ พื่อศึกษาความหมาย แนวคิดสถานภาพสัตว์ บทบาทรัฐในการควบคุมกากบั ดูแลการ
น าสัตว์มาแสดง วิเคราะห์เปรียบเทียบมาตรการทางกฎหมายในการคุ้มครองสัตว์ โดยเป็ นการวิจัย
เชิงคุณภาพ ประกอบด้วยการศึกษาข้อมูลเอกสาร วิเคราะห์เปรียบเทียบ สนทนากลุ่มและการ
สัมภาษณ์เชิงลึก ผลการวจิ ยั พบวา่ แมป้ ระเทศไทยจะมีพระราชบญั ญตั ิป้ องกนั การทารุณกรรมและ
การจัดสวัสดิภาพสัตว์ พ.ศ. 2557 แต่พระราชบญั ญตั ิดงั กล่าวไม่ไดใ้ หอ้ านาจรัฐในการเขา้ ไปควบคุม
กากบั ดูแลการนาสัตวม์ าจดั แสดงดว้ ยระบบอนุญาต ดงั เช่นกฎหมายของต่างประเทศ ทาใหผ้ จู้ ดั
แสดงสัตว์บางรายไม่จดั สวสั ดิภาพใหเ้ หมาะสมกบั สัตวจ์ นส่งผลกระทบต่อสวสั ดิภาพและสุขภาพ
ของสัตว์ ท้งั สัตวแ์ สดงเหล่าน้นั อาจเป็ นพาหะนาโรคมายงั สัตวอ์ ื่นและผชู้ ม ดงั น้นั เพื่อป้ องกนั สวสั ดิ
ภาพของสัตวแ์ ละสุขภาพของมนุษย์ การวจิ ยั น้ีเสนอใหแ้ กไ้ ขเพิ่มเติมในพระราชบญั ญตั ิป้ องกนั การ
ทารุณกรรมและการจัดสวัสดิภาพสัตว์ พ.ศ. 2557 โดยให้อ านาจรัฐในควบคุมดูแลและออก
ใบอนุญาตให้แก่ผู้ทู้ ี่ปฏิบตั ิตามหลกั เกณฑก์ารรจดั สวสั ดิภาพสัตวจ์ ากการนามาแสดง
