บทคัดย่อ
ภายใต้กฎหมายการค้าระหว่างประเทศ การระงับข้อพิพาททางเลือกได้นำมาใช้แทนการดำเนินคดีในชั้นศาลซึ่งเป็นที่นิยมมาตั้งแต่อดีตจนกระทั่งถึงปัจจุบัน โดยรูปแบบการระงับข้อพิพาทที่เป็นที่นิยมคือ การอนุญาโตตุลาการ แต่ในปัจจุบัน ได้มีวิธการระงับข้อพิพาททางเลือกอีกรูปแบบหนึ่งที่เป็นที่นิยม คือ การไกล่เกลี่ยข้อพิพาทโดยคณะกรรมาธิการว่าด้วยการจัดทำกฎหมายการค้าระหว่างประเทศได้กำหนดหลักเกณฑ์ในการระงับข้อพิพาทโดยการไกล่เกลี่ยข้อพิพาทซึ่งได้ลงนามกันที่ประเทศสิงคโปร์ หรือที่เรียกว่าอนุสัญญาสิงคโปร์ โดยในบทความนี้จะทำการศึกษาเกี่ยวกับหลักเกณฑ์ที่สำคัญภายใต้อนุสัญญาสิงคโปร์เปรียบเทียบกับหลักเกณฑ์ภายใต้พระราชบัญญัติการไกล่เกลี่ยข้อพิพาท พ.ศ.2562 โดยมีวัตถุประสงค์เพื่อพิจารณาหากประเทศไทยจะต้องเข้าเป็นภาคีในความตกลงดังกล่าวจะต้องดำเนินการปรับปรุงกฎหมายไทยอย่างไรเพื่อให้สอดคล้องกับพันธกรณีภายใต้อนุสัญญาสิงคโปร์
