Some Legal Aspects on Singapore Convention on Mediation Comparing to Thai Mediation Act B.E. 2562 (A.D. 2019)

Abstract
Under the sphere of international trade law, alternative dispute resolution has been preferred over litigation in international trade law. Arbitration is the preferred method for resolving international trade disputes. Nonetheless, another eligible method of alternative dispute resolution is 'mediation,' as proposed by the United Nations Commission on International Trade Law: UNCITRAL. The UNCITRAL proposed the mediation mechanism during the meeting in Singapore and eventually entry into force recently, or the so-called 'Singapore Convention'. This article compared the legal principles of the Singapore Convention to those of Thai law: The Mediation Act B.E. 2562. The primary objective of this comparative study is to determine to what extent the Thai government should amend this Act if Thailand wishes to gain access to this Convention in order to make Thai law compatible with international standards.
