DEVELOPMENT OF ELECTION LEGAL MEASURES FOR INMATES

Abstract

The objective of the study about “Development of Election Measures for Prisoners” is to study the provisions of the Constitution of the Kingdom of Thailand B.E. 2560 (2017), Collections Act B.E. 2560 (2017), Electoral Law and Voting Rights of Prisoners, so that prisoners are guaranteed the right to voteใ This is because the law in Thailand prohibits prisoners from voting, which may be due to many reasons such as prisoners are considered offenders, as well as it may cause insecurity if elections are held. From the study of giving prisoners the right to vote. As a result, prisoners have the opportunity to develop themselves as good people and also develop the country through political participation. However, giving the Prisoners’ right to vote only allows prisoners in the process of trial, which the court has not found guilty, including the electoral process requires a special form. because prisoners are the offenders. As prisoners are criminals, politicians have to find ways to campaign during elections to ensure safety. The campaign may be conducted via video, brochures, campaign signs, including the establishment of an appropriate election location in the prison, which must take into account the safety of the officials who manage the elections. Therefore, the development of election measures for prisoners should be improved and added as follows:

1. The provisions of the Constitution of the Kingdom of Thailand B.E. 2560 (2017) should be amended by prohibiting those imprisoned after a final sentence, including those imprisoned under a lawful order, have the right to vote.
2. Election form for prisoners with voting rights should be added in Organic Act on Election of Members of the House of Representatives B. E. 2561 (2018)
