A STUDY OF PROBLEMS IN WRITING ANSWERS TO PARTNERSHIP AND CORPORATION LAW EXAM

ABSTRACT
The purposes of the research were to study the writing method for answering law exam for third-year law students enrolling in Partnership and Company Law subject in semester 1 of academic year 2017, to compare the method to write a failed examination (F grade) with the exam answers criteria, and to study guidelines for solving problems regarding writing answer in law exam and improving students’ ability to pass law exams. The sample group was 77 third-year law students. There were 9 students chosen by the purposive sampling method. The research instruments were an evaluation form for writing answers for law exams and interview forms. Data collected from the research was analyzed by using the content analysis method.
The results showed that students’ law exams writing method conformed to subjective exam writing criteria, i.e., legal basis, analysis, and conclusion. Students were able to categorize the types of subjective exam and know the scoring criteria of 5: 15: 5. There were 6 students assessing their law exam writing skills at a level not exceeding 5 points. The results of a comparison of method to write a failed examination (F grade) with the exam answers criteria found that students could write answers about legal basis part better than analysis part and conclusion part. The score of the analysis part and conclusion part could be gained score less than 50 percent. It was found that when the students applied wrong law or regulation in their answers, the conclusion of such answers would be wrong as well. Therefore, law students have to increase writing skills for writing answers to law exams since the first year. The students should know and understand law exam writing methods such as the IRAC method and the three-part method. They also should have knowledge about law principles and regulation and be able to apply law and regulation with the questions correctly. Accordingly, the law students will successfully pass the law exams.
