Development of Pet Abduction Offense in Thailand: A Comparative Study with the United Kingdom’s Pet Abduction Act 2024
Keywords:
Animal protection, Pet abduction, Animal welfareAbstract
This study aims to analyze and compare Thai law with the United Kingdom’s Pet Abduction Act 2024, focusing on the protection of animal welfare from pet abduction. The research employs a qualitative approach, utilizing documentary research and comparative legal research methods.
The findings reveal that the United Kingdom has advanced its legal framework by elevating the status of pets from mere property under the Theft Act 1968 to sentient beings. The new legislation establishes a specific offense that emphasizes animal welfare and the emotional bond between pets and their owners. In contrast, Thai law continues to address pet abduction under the general theft provisions of the Penal Code, which limits protection to the economic value of the animal.
This article recommends that Thailand amend the Prevention of Cruelty to Animals and Animal Welfare Act B.E. 2557 (2014) by introducing a specific offense of “pet abduction,” distinct from ordinary theft. It further suggests adopting a flexible legal mechanism similar to the UK’s Henry VIII Power to enhance the law’s adaptability to future challenges.
