Implementation of the Principle of Equality Provided in the Constitution by Thai Administrative Court Leading to the Application of the Principle of Equality in Bearing Public Burdens

Abstract

Principle of Equality, the important principle to protect rights and liberties of the people, is considered as a general principle of law. This principle is regulated in the Constitution of Thailand and guarantees rights and liberties of the people which shall be treated “equality by the law”. According to this principle, person in the same situation or status should be respected equally by state, otherwise, shall be considered as the unfair discrimination. This study analyzes how the Supreme Administrative Court render judgments under the Principle of Equality. The Implementation of this principle by Thai Administrative Court leads to the application of the principle of equality in bearing public burdens in order to ensure justice to aggrieved persons.
