Abstract

The objective of the research is to create a model law on dispute resolution in criminal justice procedure. Research methodology is Qualitative research consisting of Documentary research; In-depth interviews; Participatory Design, Co- Design; and Hearing. Research found out that in the criminal justice procedure, dispute resolution can be adopted to reduce criminal cases which will cause positive impact to minimize court cases and conflicts, resulting in reconciliation in society, reduce national budget, and strengthen the society in living together in a normal happy way. The dispute resolution model can be done at all stages of the judicial process and must have laws to support according to the model law created. The structure of model law consisting of Mediation; Suspension of prosecution; No prosecution to non-public interest; Plea-bargaining, which will lead to the amendment of the Mediation Dispute Act BE 2562. Research recommended that the Model Law of this research should be utilized for the amendment of the Mediation Dispute Act BE 2562. Further research are"Model Law on Promoting Mediation Disputes Resolution in the Community" and "Laws on Civil Dispute Resolution".
