บทคัดย่อ

บทความนี้มุ่งวิเคราะห์การปะทะกันอย่างรุนแรงระหว่างสิทธิทางวัฒนธรรมของชนกลุ่มน้อยกับกฎหมายและนโยบายสวัสดิการของรัฐในสังคมพหุวัฒนธรรม โดยใช้ภาพยนตร์เรื่อง Mrs. Chatterjee vs Norway เป็นกรณีศึกษา บทความมีจุดมุ่งหมายเพื่อทำความเข้าใจขีดจำกัดของการใช้กฎหมายที่เน้นความเป็นกลางทางวัฒนธรรมและประเมินประสิทธิผลของแนวคิดพหุวัฒนธรรมเสรีนิยมแบบดั้งเดิม การวิจัยครั้งนี้ใช้การวิจัยเชิงคุณภาพ โดยนำกรอบแนวคิดของ Will Kymlicka เรื่องสิทธิกลุ่ม และแนวคิดสมรรถภาวะ (Capability Approach) ของ Amartya Sen มาเป็นเครื่องมือในการวิเคราะห์และวิพากษ์ ผลการศึกษาพบว่า การบังคับใช้กฎหมายโดยขาดความเข้าใจในบริบททางวัฒนธรรมส่งผลให้เกิดการลิดรอนบริบทของการเลือก (Context of Choice) ของชนกลุ่มน้อยอย่างไม่เป็นธรรม เพื่อที่จะแก้ปัญหานี้จะต้องมีการตีความเรื่องความยุติธรรมที่ต้องคำนึงถึงความซับซ้อนภายในกลุ่มน้อย (Intra-Group Differences) ซึ่งส่งผลต่อการปรับตัวของสมาชิกที่แตกต่างกัน ข้อเสนอแนะที่สำคัญคือ การสร้างความสมดุลระหว่างสิทธิทางวัฒนธรรมและสิทธิปัจเจกบุคคล (โดยเฉพาะสิทธิเด็ก) ผ่านการใช้ สมรรถภาวะเพื่อรับประกันเสรีภาพและโอกาสของสมาชิกกลุ่มน้อยแต่ละคน บทความเสนอให้มีการพัฒนานโยบายและระบบสวัสดิการที่ส่งเสริมอัตลักษณ์ผสม (Hybrid Identity) และความสามารถเชิงวัฒนธรรมเพื่อให้เกิดความยุติธรรมที่แท้จริงในสังคมพหุวัฒนธรรม
