BENEFITS TO THAILAND FROM ASEAN-HONG KONG FREE TRADE AGREEMENT AN ANALYSIS OF POLICY AND INVESTMENT LAW

The ASEAN-Hong Kong Free Trade Agreement is the 6th agreement between ASEAN and its trading partners, enabling ASEAN to utilize Hong Kong as a hub of goods distribution especially to large market as China. Because Hong Kong has a Closer Economic Partnership Arrangement (CEPA) with China. Whether the ASEAN-Hong Kong Free Trade Agreement will promote increased investment in Thailand from Hong Kong depends on several issues, such as: do the general policies and investment laws increase partner country investor confidence; are required expectations and processes fair to investors or the National Treatment (NT), and; are investors of the compatible to the Most-Favored Nation Treatment (MFN) with no privileges for investment protection? This should include the provision of justice in legal and administrative processes, along with quick and convenient consideration of investments, taxation incentives, creating an appropriate investment environment, providing convenient funds transfer procedures for investment and international currency exchange.
