พัฒนาการของแนวคิดสิทธิมนุษยชนด้านสิ่งแวดล้อมในรัฐธรรมนูญไทยระหว่าง พ.ศ. 2475 - 2560 -

บทคัดย่อ
งานวิจัยชิ้นนี้มุ่งศึกษาพัฒนาการของแนวคิดด้านสิทธิมนุษยชนด้านสิ่งแวดล้อมในรัฐธรรมนูญไทยระหว่าง พ.ศ. 2475 – 2560 โดยสิทธิมนุษยชนที่มีนัยยะสาคัญในมิติด้านสิ่งแวดล้อม ไม่ว่าที่เป็นสิทธิเชิงเนื้อหา (substantive right) หรือสิทธิเชิงกระบวนการ (procedural right) ผลของการศึกษารัฐธรรมนูญทั้ง 20 ฉบับพบว่า แนวคิดด้านการคุ้มครองสิ่งแวดล้อมเริ่มปรากฏอย่างเป็นรูปธรรมในรัฐธรรมนูญฉบับปี 2517 ในขณะที่สิทธิมนุษยชนด้านสิ่งแวดล้อมเชิงกระบวนการเริ่มปรากฎอย่างเป็นรูปธรรมในรัฐธรรมนูญปี 2540 หลังจากนั้น ไม่พบว่ามีพัฒนาการเกี่ยวกับสิทธิมนุษยชนด้านสิ่งแวดล้อมเชิงเนื้อหาในรัฐธรรมนูญในระดับก้าวกระโดด งานวิจัยชิ้นนี้สรุปว่า เนื้อหาของรัฐธรรมนูญไทยยังไม่เคยมีภาษาที่รับรองสิทธิมนุษยชนด้านสิ่งแวดล้อมเชิงเนื้อหาอย่างไม่มีข้อกังขา ควรกล่าวไว้ว่า ขอบเขตของการศึกษานี้ไม่ได้ครอบคลุมการนาภาษาในรัฐธรรมนูญมาใช้ในการฟ้องร้องและตัดสินคดีความด้านสิ่งแวดล้อม และไม่ได้ปฏิเสธความเป็นไปได้ว่า การตีความภาษาในรัฐธรรมนูญไทยอาจนาไปสู่การรับรองสิทธิด้านสิ่งแวดล้อมเชิงเนื้อหาในทางปฏิบัติ
