Abstract

เงินเพิ่มสำหรับตำแหน่งที่มีเหตุพิเศษ (พ.ต.ก.) เป็นผลผลิตแห่งความพยายามในการสร้างมาตรฐานนักกฎหมายภาครัฐเพื่อแก้ไขความไม่เป็นธรรมในการกำหนดค่าตอบแทนสำหรับนิติกรเมื่อเทียบกับข้าราชการฝ่ายตุลาการ อัยการหรือพนักงานองค์กรอิสระ ปัญหาดังกล่าวก่อให้เกิดภาวะสมองไหล (brain drain) ขาดแคลนกำลังคนนิติกรในภาคราชการฝ่ายบริหาร อย่างไรก็ตาม ยังมีความไม่ชัดเจนในรายละเอียดของคุณสมบัติและพฤติกรรม ช่องว่างในการกำหนดค่าคาดหวังของการประเมิน จำนวนชั่วโมง/วัน อุปสรรคด้านค่าใช้จ่ายในการฝึกอบรมเพื่อประกอบการขอรับเงิน พ.ต.ก. ความต่อเนื่องในการรักษามาตรฐาน จึงควรมีการติดตามประเมินผลการปฏิบัติตามกฎหมาย การเพิ่มโอกาสในการฝึกอบรม การปรับปรุงเนื้อหาและพัฒนาหลักสูตรอย่างต่อเนื่องเพื่อก้าวสู่มาตรฐานนักกฎหมายภาครัฐที่มีความเป็นมืออาชีพสมดังเจตนารมณ์ของการกำหนดให้มีเงิน พ.ต.ก.สำหรับผู้ดำรงตำแหน่งนิติกรต่อไป

SUPPLEMENTARY COMPENSATION…APPROACH TO STANDARD GOVERNMENT LAWYER

Supplementary compensation is a product of trying to establish a standard in order to solve inequity in existing compensation when compares with that of judge, attorney and constitutional independent entities. It causes brain drain, lack of quality government lawyers in administrative section. However, there are nonspecific in details of qualification and lawyers behavior, unclear of expected level of evaluation, different number of training hour/day and registration fee for consideration ,and broken chain to maintain a standard. To make the betterment, the following outcomes should be checked. In addition, it is necessary to expand an opportunity to attend a class, continuing improvement a training course syllabus in order to be professional standard government lawyers to fulfill a spirit of law as supplementary compensation principle.
