A Study of Legal Impact for Thailand to Ratify the Violence and Harassment Convention (No. 190)

Abstract
The purposes of this research were to: 1) study the Labour Protection Act B.E. 2541, including other laws related to the protection of labours from violence and harassment; 2) study the Violence and Harassment Convention, 2019 (No. 190); 3) analyze the Labour Protection Act B.E. 2541, along with other laws related to the protection of labours from violence and harassment comparing with the Violence and Harassment Convention, 2019 (No. 190) and 4) seek suggestions for the developing laws related to the protection of labours from violence and harassment in order to be appropriate and efficient. This study was a documentary research by using books, journal articles, theses and related electronic media
It was found that Thailand does not provide the specific law enacted for protecting labours from violence and harassment. Although, there are some principles of the Violence and Harassment Convention, 2019 (No. 190) emerged into many domestic laws of Thailand, the laws are intended to be used as an enforcement in different purposes not for protecting labours from violence and harassment specifically. Moreover, many issues are not enacted for complying with the Violence and Harassment Convention, 2019 (No. 190)
It was recommended that specific law should be enacted for protecting labours from violence and harassment at work and its principles comply with the Violence and Harassment Convention, 2019 (No. 190) in order to ensure that the protection of labours is appropriate, adequate and consistent with international principles. While specific law has not been nevertheless enacted, involved agencies should raise awareness, educate or set good practice for employers, employees or establishments regarding the protection for labours from violence and harassment at work. Furthermore, there should be a mechanism performed by competent authorities for controlling and inspecting establishments, employers or involved people in order to prohibit in all acts of violence or harassment against labours.
