Labour Protection on Occupational Safety and Health Law and Thailand Institute of Occupational Safety and Health Establishment Law

Abstract

This research aims to study Thai Law, Foreign Law, International Labour Standards, concepts and theories related to occupational safety and health including the institute of occupational safety and health establishment in order to develop the occupational safety and health law and Thailand institute of occupational safety and health establishment law by using the results of this research. The results are from revising the relevant books, articles, legal documents, research and in-depth interview. It was found that the labour protection of occupational safety and health is the fundamental human rights which every labour should be protected. As the damages to employees, employers, and economy caused by accidents or illness from working, every country emphasizes enacting domestic law for protecting labours. Moreover, International Labour Organization adopts international labour standards toward member states’ implementation. In case of Thailand, the Occupational Safety, Health and Environment Act B.E. 2554 has been legislated in order to standardize the safety management in workplaces. In addition, the Royal Decree on the Establishment of Institute of Occupational Safety and Health (Public Organization) B.E.2558 has been enacted in order to set up the specialized institute for promoting occupational safety and health. However, some cases of both stated laws are not proper which might effect on efficiency of safety management and promotion in workplaces. It is recommended that provisions and structure of occupational safety and health law should be amended. Including, the institute of occupational safety and health establishment law should be appropriately amended in terms of administrative structure, authority. Futhermore, consciousness and preventative safety and health culture should be raised seriously.
