Developing Criminal Dispute Mediation at the Inquiry Stage: A Policy and Practice Framework for Thailand’s Eastern Economic Corridor (EEC)

Abstract

               This research article aimed to synthesize policy recommendations, practical recommendations, and an integrated framework for developing criminal dispute mediation at the inquiry stage in Thailand’s Eastern Economic Corridor (EEC). A mixed-methods research design was employed. Quantitative data were collected through questionnaires administered to 222 police investigators in Chonburi, Rayong, and Chachoengsao provinces. Qualitative data were obtained through semi-structured in-depth interviews with 15 key informants, comprising senior police administrators, police station chiefs or heads of investigation units, and mediators registered with the Royal Thai Police, together with an analysis of relevant documents. Quantitative data were analyzed using descriptive statistics, while qualitative data were examined through content and thematic analyses, with triangulation used to enhance the credibility of the findings. Three major findings emerged. First, criminal mediation was still perceived as an optional task because it lacked clear policy direction and institutional status within the investigation system. Second, implementation was constrained by investigators’ workloads, insufficient resources and supporting personnel, and the absence of systematic monitoring mechanisms. Third, the effectiveness and sustainability of mediation depended on practitioners’ competencies and collaborative networks among police, mediators, communities, and relevant agencies. The study recommends institutionalizing mediation as a core function of police investigation, developing outcome-oriented performance indicators, allocating dedicated resources and support systems, providing competency-based training, and establishing pilot sites in the EEC before expanding the model nationwide.
