https://so03.tci-thaijo.org/index.php/rpu/article/view/292970

This research adopts a qualitative research methodology focusing on the legal problems regarding the process of obtaining informed consent from patients—a matter of considerable significance in both legal and social science disciplines, with profound implications for the doctor-patient relationship. The objectives of this study are 1) to study the evolution, concepts, theories, definitions, forms, and procedures associated with informed consent in medical practice 2) to analyze the relevant legal frameworks governing informed consent in Thailand and selected foreign jurisdictions in the context of professional medical services 3) to examine the legal and practical problems involved in obtaining medical consent in the context of professional medical practice in Thailand 4) to propose guidelines for the improvement and development of Thai legal provisions concerning informed consent in medical practice.

The findings reveal that Section 8, Paragraph 1 of the National Health Act B.E. 2550 (2007), the Patient Rights Declaration B.E. 2541 (1998), and the Declaration of Patient Rights and Duties B.E. 2558 (2015) merely provide broad provisions without clearly defined legal procedures for obtaining valid consent. In comparison, No. 61 of 2003: the National Health Act, 2004. (Republic of South Africa), the Health Care Consent Act, 1996 (Ontario, Canada), and the German Civil Code (Bürgerliches Gesetzbuch – BGB) demonstrate that these laws provide a more clearly defined framework and scope regarding the information required for informed consent than that currently found in Thailand. Accordingly, the researcher proposes the amendment of definition and obtainaing informed consent process in Section 8 of the National Health Act B.E. 2550 (2007) and recommends that the relevant authorities draft a specific act governing informed consent for medical practitioner. The enactment of a clear and comprehensive legal framework for informed consent would mitigate potential disputes between doctor and patients, and foster stronger, more trusting doctor-patient relationships in the long term.
Chai NimlamaiPairoj Boonsirikamchai

https://so03.tci-thaijo.org/index.php/rpu/article/view/292981

This study aimed to identify the key factors influencing the selection of sea freight forwarding services based on the 7 Rights (7R) framework and to examine the impact of demographic characteristics on decision-making in logistics service utilization. The research sample consisted of 50 entrepreneurs, including business owners and decision-makers who engaged with a case study freight forwarding company. Data were collected using questionnaires, with instrument validity ranging from 0.67 to 1.00 and a reliability coefficient of 0.87. The data were analyzed using descriptive statistics—frequency, percentage, mean, and standard deviation—as well as inferential statistics, specifically One-Way ANOVA (F-test).

The findings revealed three key results. First, most respondents were female, aged between 21 and 41 years, held a bachelor’s degree, and operated their businesses as limited companies. The majority were small enterprises with assets not exceeding 50 million baht and had been in operation for five to ten years. Second, among the 7R factors, the most influential determinant in selecting logistics services was “Right Cost” (Mean = 4.26), followed by “Right Quantity” (Mean = 4.20) and “Right Time” (Mean = 4.16). These results highlight the central role of competitive pricing, accurate service capacity, and timely delivery in customer decision-making. Third, demographic characteristics related to business profiles were found to significantly influence all aspects of service selection at the 0.05 level, suggesting that business size, structure, and experience directly shape logistics service preferences. In conclusion, the study demonstrates that both service quality dimensions under the 7R framework and demographic characteristics critically influence logistics service selection. The results provide practical insights for freight forwarders to develop competitive strategies—particularly in cost, service accuracy, and timeliness—aligning services more effectively with the diverse needs of business customers.
Siripapan PhuathadBavornwit Rojsuwan
