The research employed a qualitative approach, utilizing document analysis and in-depth interviews with 14 key informants. The findings revealed that the overall management of the CDC was compliant with the standards. However, significant problems and obstacles were found in three main areas: Management, primarily a lack of budget for facility maintenance; Personnel, a critical shortage of certified child caregivers, with the personnel-to-child ratio not meeting the standard, requiring one teacher to oversee five centers; and Facilities, with several buildings showing deterioration due to long-term use and a lack of maintenance funds. The proposed development guidelines consisted of 8 key recommendations: 1) Consolidating centers for efficiency; 2) Surveying personnel and staffing needs; 3) Providing continuous training; 4) Seeking funding sources; 5) Building cooperation networks; 6) Formulating procurement policies favorable to maintenance; 7) Renovating facilities according to standards; and 8) Continuous inspection, monitoring, and evaluation.</p> Benjamas Pongaree, Arunrat Jinda Copyright (c) 2025 Journal of Law and Political Affairs http://creativecommons.org/licenses/by-nc-nd/4.0 https://so03.tci-thaijo.org/index.php/JPG/article/view/288404 Thu, 25 Dec 2025 00:00:00 +0700 Management of Criminal Records for Children and Youth https://so03.tci-thaijo.org/index.php/JPG/article/view/293550 <p>The objectives of this research were to analyze problems, obstacles, and compare legal measures regarding juvenile criminal records in Thailand and other countries, and to propose legal measures for managing juvenile criminal records. The study examined documents and concepts related to juvenile justice processes and criminal record management, as well as approaches to criminal record management in France, Canada, and Singapore. The data was analyzed using descriptive analysis. The findings showed that 1) The main issues with juvenile criminal records are the enforceability of laws, data storage, problems with deleting or segregating records, and issues of disclosure. 2) France, Canada, and Singapore have laws equivalent to Acts governing the recording of juvenile criminal history, with data used only within the justice system, and provisions for deleting criminal records. The research investigates the appropriateness of criminalizing conduct of a purely regulatory nature under this provision and explores the potential for replacing such criminal sanctions with administrative and regulatory fines. The analysis is grounded in various theoretical frameworks, including the principles of criminal punishment, decriminalization, administrativization, and regulatory sanctioning. Comparative legal perspectives from foreign jurisdictions are also considered. This study finds that the offense under section 22 constitutes a regulatory or technical violation rather than a serious crime that causes substantial harm to society. As such, the imposition of imprisonment or criminal fines is unlikely to be proportionate or effective. The provision appears to be outdated and may no longer be necessary under the current legal and social context. In response, this study recommends that the effectiveness of the Export and Import of Goods Act B.E. 2522 be re-evaluated. Data were collected from 79 DPM personnel in Chon Daen District using a questionnaire as the main research instrument. The statistics employed were frequency, percentage, mean, standard deviation, and content analysis for open-ended questions.</p> <p> The research findings revealed that, across four aspects of DPM operations, the LAOs in Chon Daen District reported the highest level of performance in Operational Monitoring and Inspection, followed by Operational Planning. The level of performance concerning the Actual Implementation of Technology was third, and the lowest was Coordination with the Community, respectively. The study aims to explore the origins and significance of the definitions and principles of community policing, as well as its implementation in various countries. The discussion begins with the United States, particularly in Chicago, where crime control strategies focus on fostering familiarity with community members and coordinating with relevant agencies. In Japan, the KOBAN police box system has been established to enhance surveillance and provide greater accessibility to the public. Additionally, the article examines the adoption of community policing in Latin American countries. Regarding Thailand, the study outlines the step-by-step approach to community policing, starting from identifying local leaders, initiating ideas, studying community backgrounds, making decisions and formulating projects, implementing activities, and conducting evaluations. The research also explores the adaptation of community policing within various contexts, including cultural, legal, and linguistic differences, as well as in response to specific situations such as the COVID-19 pandemic. Ultimately, community policing is regarded as a key mechanism for ensuring the safety of life and property. In the absence of effective and well-structured preparation, the nation is likely to face adverse consequences stemming from the rising burden of healthcare expenditures, particularly due to the increased prevalence of chronic diseases and the associated costs of medical equipment, pharmaceuticals, and other materials required for the provision of public healthcare services. Consequently, public procurement assumes a critical role in reinforcing the stability and resilience of Thailand’s health system, particularly through policies that promote greater self-reliance in the development of domestic pharmaceutical and medical device industries. Nevertheless, following the enactment and enforcement of the Public Procurement and Supplies Administration Act B.E. 2560 (2017), government agencies have frequently encountered difficulties in complying with prescribed procurement procedures. These challenges often arise from inadequate understanding of the relevant regulations, as well as delays caused by mandatory procedural steps stipulated by law. For instance, Section 114 requires that appeals be resolved prior to the execution of any contract, in accordance with Section 66 paragraph two. Although the statute provides exceptions in the closing part of Section 66 paragraph two, most government agencies tend to suspend procurement processes pending the outcome of the appeal review. This practice may, however, result in harm to the continuity and efficiency of public service delivery, largely due to uncertainties in statutory interpretation and apprehension regarding the justification of actions taken. It is therefore incumbent upon government agencies and supervisory authorities to ensure that procurement personnel are thoroughly instructed and properly guided on the application of the statutory exceptions.
