TY - JOUR AU - แนบกลาง, สมศักดิ์ PY - 2013/03/14 Y2 - 2024/03/29 TI - รูปแบบที่เหมาะสมกับการให้เอกชนเข้าร่วมงานหรือดำเนินการในกิจการของรัฐ ศึกษากรณี : สัญญาจ้างเหมาแบบเบ็ดเสร็จ JF - Trends of Humanities and Social Sciences Research JA - Trends Humanit Soc Sci Res VL - 1 IS - 1 SE - Research Article DO - UR - https://so03.tci-thaijo.org/index.php/Humanties-up/article/view/42669 SP - 11-19 AB - <p>ในการจัดทำบริการสาธารณะถือเป็นหน้าที่ของรัฐที่จะต้องจัดทำเพื่อตอบสนองความต้องการของประชาชนส่วนรวม แต่ด้วยสภาพทางเศรษฐกิจ ตลอดจนภาระหน้าที่ต่างๆ ของรัฐทำให้รัฐไม่อาจจัดทำบริการสาธารณะให้กับประชาชนส่วนรวมได้อย่างรวดเร็วและทั่วถึง ดังนั้น รัฐจึงจำเป็นที่จะต้องมอบหมายให้เอกชนเข้าร่วมงานหรือดำเนินการในกิจการของรัฐบางประเภท ทั้งนี้ รัฐจะใช้สัญญาทางปกครองเป็นเครื่องมือในการควบคุม และมอบหมายให้เอกชนจัดทำบริการสาธารณะแทนรัฐ ดังนั้น การเข้าทำสัญญาระหว่างรัฐกับเอกชนจึงต้องอยู่ภายใต้กฎหมายที่ตราขึ้นมาเพื่อควบคุมและตรวจสอบรวมถึงการคุ้มครองประโยชน์ของรัฐ (พระราชบัญญัติว่าด้วยการให้เอกชนเข้าร่วมงานหรือดำเนินการในกิจการของรัฐ พ.ศ. 2535)</p><p>อย่างไรก็ตาม จากการศึกษาถึงลักษณะและรูปแบบของสัญญาที่รัฐมอบหมายให้เอกชนเข้าร่วมงานหรือดำเนินการในโครงการต่างๆ ของรัฐแล้วเห็นว่า มีสัญญาบางประเภทที่ไม่ได้อยู่ในความหมายของกฎหมายที่ได้กล่าวมาแล้ว คือ สัญญาจ้างเหมาแบบเบ็ดเสร็จ (Turnkey) ซึ่งเป็นรูปแบบที่รัฐมอบหมายให้เอกชนเข้ามาเป็นผู้ลงทุนแบบเบ็ดเสร็จ ตั้งแต่การออกแบบและจัดหาแหล่งเงินทุน ก่อสร้าง จนกระทั่งแล้วเสร็จ ก่อนที่จะส่งมอบโครงการที่ก่อสร้างแล้วเสร็จนั้นให้แก่รัฐ ดังนั้น จึงเห็นสมควรศึกษาถึงสถานะและรูปแบบที่ควรจะเป็นของสัญญาในลักษณะดังกล่าว ซึ่งไม่มีหลักเกณฑ์หรือวิธีการในการควบคุมและตรวจสอบการมอบหมายให้เอกชนเข้าร่วมงานหรือดำเนินโครงการของรัฐเช่นเดียวกัน (พระราชบัญญัติว่าด้วยการให้เอกชนเข้าร่วมงานหรือดำเนินการในกิจการของรัฐ พ.ศ. 2535)     </p><p> </p><p><strong>The Sufficient Framework for Private Sector to Operate Public Enterprises in Case of Turnkey Contract</strong></p><p><em>Somsak  Nabklang</em></p><p><em>School of law, University of Phayao</em></p><p>It is the responsibility of government to provide public services for the people. However, the current economic conditions and the limitation on ability of the government make it difficult for the government to accomplish such task effectively and properly. Therefore, the government needs the private sector to invest in some state enterprises. The government normally relies on administrative contract between the state and private parties as an instrument to control the private parties who offer public services on behalf of the government.  The private sector who participates and invests in public services under the aforementioned contract is subject to the control of laws which protect the interests of the State and the public such as (The <em>Private Participation in State</em><em> </em>Undertaking B.E. 1992.)</p><p>Nevertheless, the study of feature and forms of administrative contracts, which allow the private parties to participate in providing public services on behalf of the government in several cases, indicate that some types of administrative contracts do not fall within the scope and control of the <em>Private Participation in State</em><em> </em>Undertaking B.E.<em> </em><em>2535</em><em> </em>(1992) such as turnkey contract (also known as turnkey construction contract). The turnkey contract is the contract that allows the private parties or contractors to be fully responsible for producing the design, finding funding and investment, building and constructing it until the completion of the project. Then, when the project is successfully completed, the private contractors will hand over it to the government. The study considers what should be appropriate framework or model for private sector to operate public service in case of turnkey contract, which is currently not subject to any legal measures and controls of (The <em>Private Participation in State</em><em> </em>Undertaking B.E. 1992.)   </p><p><strong><br /></strong></p> ER -
